Limited Product Warranty
1. Application
1.1. This limited warranty covers all of and only the products available for sale by ADG Enterprises, LLC (“Company”) on shop.airboss.com (the “Site”) and each of their component parts (collectively, the “Products”).
1.2. This limited warranty extends only to the person who originally purchases the Products (“Purchaser”) and is not transferable. Resale, gifting, or subsequent transfers of Products are not covered.
2. Limited Warranty
2.1. Company warrants to Purchaser that the Products, when used specifically as authorized by Company and without modification thereto, will conform in all material respects to: (i) the specifications set forth on the Site; and (ii) any instructions that we provide you with upon delivery of the Products, during the Warranty Period.
2.2. Company warrants to Purchaser that the Products will be free from defects in material, functionality, and workmanship during the Warranty Period.
2.3. Notwithstanding anything to the contrary herein, this warranty shall not apply if the Products are or have been subject to: negligence, misconduct, misuse, abuse, accident, improper installation or handling, unusual environmental conditions, other extreme stress, alteration, unauthorized repair, use with any third-party product or service (other than as specifically authorized in advance by us), or use in violation of any provided-for instructions or license terms.
2.4. Any products manufactured by a third party and incorporated in the Products, which may be covered solely by the applicable third-party manufacturer’s warranty, if any, are not covered by this limited warranty.
2.5. Company warrants to Purchaser that it will perform any services purchased together with the Products using qualified personnel in a professional and workmanlike manner consistent with generally recognized industry standards.
2.6. SUBJECT TO APPLICABLE LAW AND THE TERMS HEREOF, COMPANY MAKES NO EXPRESS OR IMPLIED WARRANTY WHATSOEVER WITH RESPECT TO THE PRODUCTS, INCLUDING WITHOUT LIMITATION ANY: (I) WARRANTY OF MERCHANTABILITY; (II) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; (III) WARRANTY OF TITLE; OR (IV) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY, WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OR TRADE, OR OTHERWISE.
2.7. This limited warranty is valid for twelve (12) months from the date of delivery of the Products (the “Warranty Period”). This period is not extended if Company repairs or replaces a warranted Product or re-performs a warranted service.
2.8. This limited warranty is void if the Products are exported, transferred, resold, or used in violation of applicable U.S. or Canadian export control laws, including without limitation the U.S. International Traffic in Arms Regulations (ITAR), the Export Administration Regulations (EAR), or the Canadian Controlled Goods Program, to the extent applicable.
2.9. PPE and Safety Critical Products. Products such as respirators, filters, and other personal protective equipment (“PPE”) must be used strictly in accordance with all instructions, warnings, training requirements, and applicable regulatory standards. Company does not warrant or guarantee that any PPE will prevent exposure to contaminants, hazards, pathogens, chemicals, or other harmful substances, or will prevent illness, injury, or death. Proper fit testing, training, inspection, maintenance, and use are solely the Purchaser’s responsibility. Warranty coverage does not apply to performance issues arising from improper fit, improper use, inadequate training, or failure to follow safety protocols.
2.10.Exclusions for Wear and Consumables. This limited warranty does not cover normal wear and tear; consumable or disposable components (including filters, cartridges, valves, and seals); cosmetic damage; degradation due to environmental exposure (including UV, chemicals, temperature, or humidity); or performance degradation resulting from ordinary use. These conditions do not constitute defects in materials or workmanship.
3. Purchaser’s Sole and Exclusive Remedies
3.1. Purchaser’s sole and exclusive for a breach of any part of this limited warranty is to notify the Company, in writing, with a detailed explanation of the claimed defect or non-conformance, within thirty (30) days after discovery (or when such defect reasonably should have been discovered). Company reserves the right to verify claims in accordance with its customary procedures.
3.2. Upon validation of a warranty claim, Company will, at its option: (i) repair or replace the defective Product (or re-perform the services, as applicable); or (ii) credit or refund the purchase price.
3.3. Where Purchaser validly exercises their right to a remedy as set forth in subsection 3.1 above:
3.3.1. A restocking fee shall not apply;
3.3.2. Company shall have the right to select which remedy shall apply; and
3.3.3. Company will bear shipping and handling charges for sending replacement goods and assume the risk of loss during such shipment. Purchaser remains responsible for the cost and risk of loss of returning Products to Company, unless otherwise required by applicable law.
4. To obtain warranty service, Purchaser must provide proof of purchase and obtain a Return Merchandise Authorization (“RMA”) number from Company before returning any Products.
5. If for any reason Purchaser believes in good faith that Company has not fulfilled its obligations hereunder, Purchaser is entitled to follow the dispute resolution procedures set forth in the terms and conditions.
6. SUBJECT TO APPLICABLE LAW, THE REMEDIES SET FORTH ABOVE ARE PURCHASER’S SOLE AND EXCLUSIVE REMEDIES, AND COMPANY’S ENTIRE OBLIGATION AND LIABILITY, FOR ANY BREACH OF COMPANY’S LIMITED WARRANTY. SUBJECT TO APPLICABLE LAW, UNDER NO CIRCUMSTANCES WILL COMPANY'S OBLIGATION OR LIABILITY HEREUNDER EXCEED THE PRICE PURCHASER PAID FOR THE PRODUCTS. ADDITIONALLY, SUBJECT TO APPLICABLE LAW, UNDER NO CIRCUMSTANCES WILL COMPANY BE LIABLE FOR any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of use, data, business, goodwill, or revenue.
7. General
7.1. Nothing in this limited warranty affects any rights Purchaser may have under applicable consumer protection laws that cannot be waived or limited by contract.
7.2. In the event of a conflict between this limited warranty and any warranty documentation provided with the Products, this limited warranty shall control.
