Export Control Policy

1. Introduction
1.1. At ADG Enterprises, LLC (“we”, “ADG”, “our”, or “us”), we are committed to compliance with applicable export control laws and regulations in Canada and the United States. This policy outlines the restrictions and responsibilities associated with the online sale of all export-controlled products sold through the site, including the following products:
1.1.1.Vapour Barrier Bunny Boot (VBBB)
1.1.2.Extreme Cold Weather Mukluk
1.1.3.AirBoss 100 Respirator and Filters
1.1.4.Low-Burden Mask (LBM) and Filters
1.1.5.C4 CBRN Gas Mask and Filters
1.2. Export Control Compliance
1.2.1.The above products, particularly those with personal protective, military, or dual-use functionality, may be subject to the Canadian Export and Import Permits Act (EIPA) and the U.S. Export Administration Regulations (EAR) and/or International Traffic in Arms Regulations (ITAR).
1.2.2.These laws prohibit the unauthorized export, re-export, or transfer of certain items to:
1.2.2.1.Specific countries, including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine,
1.2.2.2.Individuals or entities on government-sanctioned lists, including the U.S. Entity List, the List of Statutorily Debarred Parties, and OFAC’s List of Specially Designated Nationals and Blocked Persons, or
1.2.2.3.End-uses related to military, chemical/biological weapons, or terrorism or otherwise prohibited under applicable law.
1.3. ADG will not ship controlled products to any destination or person prohibited under these regulations.
2. Online Sales and Geographic Restrictions
2.1. ADG currently limits the sale and shipment of the above-listed products to residents and addresses located within Canada and the United States. International customers must contact ADG directly to determine eligibility and compliance requirements. For greater certainty, Canada is treated as an “international destination” for export-control purposes.
2.2. ADG reserves the right to:
2.2.1.Cancel any order that appears to violate applicable export control laws,
2.2.2.Request additional end-user certifications or documentation, and
2.2.3.Report suspicious orders to the relevant authorities.
3. Permits and Licensing
3.1. Some of the products available on this website may require an export permit or license before being shipped outside of Canada or the U.S., even if the buyer is a private individual.
3.2. Buyers are solely responsible for determining whether any export license, permit, authorization, or other government approval is required for the export, re-export, transfer, or downstream use of any product purchased through this website, and for obtaining and maintaining any such authorization.
4. Buyers are responsible for:
4.1. Understanding the applicable laws in their jurisdiction,
4.2. Ensuring that they are not located in or acting on behalf of a restricted or sanctioned entity, and
4.3. Notifying ADG of any intended re-export or transfer of these products, prior to any such re-export or transfer.
5. Indemnification
5.1. Buyers agrees to indemnify, defend, and hold harmless ADG and its affiliates, officers, directors, employees, and agents from and against any claims, losses, damages, penalties, fines, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to the buyer’s breach of this Policy, misrepresentation, unauthorized export, re-export, or transfer of products, or violation of applicable export control or sanctions laws.
6. ADG may delay or withhold shipment pending export authorization if necessary.
7. End-User and End-Use Declarations
7.1. By purchasing regulated products, customers certify that:
7.1.1.The products will be used for lawful, non-military, civilian purposes only
7.1.2.They are not located in or exporting to a restricted destination, and
7.1.3.They are not listed on any sanctioned party lists (including, without limitation: U.S. Denied Persons List, Entity List, or Canadian Area Control List).
